LPSK Confirms Return of Rs 120 Billion to David is the Responsibility of Mario Dendi

Mario Dendi Satrio’s lawyer Andreas Nahot Silitonga said that Cristalino’s assistance to David Ozora could be paid from the budget of the Agency for the Protection of Witnesses and Victims (LPSK). LPSK Vice Chairman Edwin Partogi stated that providing psychological assistance to psychosocial people is indeed part of the LPSK advocacy program.

“Yes, if the help is right, the mentioned help goes through all the medical, psychological and psychosocial rehabilitation, which is really part of the protection program,” Edwin said on Tuesday (August 29, 2023).

However, Edwin said that the assistance provided by LPSK is different from restitution or compensation to victims. Edwin said that the responsibility for restitution lay with the perpetrators of the crime, which in this case was Mario Dendi Satriyo.

“But this is a completely different matter than restitution. The victims that LPSK deals with are not only Mario Dendi, of course there is a time limit, there is a budget limit that LPSK can allocate. But as far as restitution is concerned, it’s really a responsibility. Therefore, it would be wrong if the LPSK were required to compensate for the damage,” he said.

“So between the recovery that LPSK is doing and the offender’s obligation to pay compensation are two different things,” he continued.

According to him, the compensation provided by LPSK cannot distract the offender from the obligation to pay compensation. Edwin said that the state requires those guilty of criminal acts to pay compensation for their actions.

“So there is indeed a restoration that LPSK has done, but not a transfer of the responsibility of the perpetrator or the responsibility of the perpetrator to LPSK, because it was Mario Dendy who did the deed to David Ozora. The state requires the offender to pay compensation,” said Edwin.

Previously, Andreas had refused to pay Rs 120 billion in compensation or damages to Cristalino David Ozora. Andreas said that assistance to the victims could be paid from the LPSK budget.

Andreas made the announcement while reading Mario Dandy’s copy of David Ozora’s Cristalino Assault Case at South Jakarta District Court on Tuesday (August 29). Initially, Andreas referred to the rules for assisting victims of abuse crimes.

“The Legal Advisory Group is of the opinion that in order to alleviate the suffering of child victims, this should be done in accordance with paragraph 1 of Article 37 and paragraph 2 of GD No. 7 of 2018, which identifies witnesses or victims of gross violations of human rights, criminal terrorist acts, criminal acts of human trafficking, criminal acts of torture, crimes of sexual violence and serious ill-treatment are eligible for assistance,” said Andreas.

The provision of such assistance as medical care, psychosocial assistance, he called psychology. He said victims of abuse were entitled to receive assistance in accordance with the rules.

“This government decree also includes provisions in the LPSK budget for financing the payment of compensation for assistance. The payment of funds for compensation and assistance is carried out in accordance with the provisions of the law,” Andreas said.

“Rejected the calculation of the restitution of the LPSK, since it was not made on the basis of the current legislation,” he continued.

Mario Dendi Satriyo was sentenced to 12 years in prison in connection with the attack on David Ozora. Prosecutors also demanded that Mario Dendi pay 120 billion rupees in compensation, and his subsidiary – 7 years in prison.

Mario Dendi admitted that he could not believe that the prosecutor did not include in his charge items that could mitigate the sentence. He also admitted that he is ready to pay as much compensation as he can.
